Buyers Terms & Conditions
1. All lots are made available for inspection/viewing before each sale. No reference is made as to the condition of any item in the catalogue, but this does not imply that it is free of faults or restoration. The condition of the Lot or Lots can vary widely due to factors such as age, previous damage, restoration, repair and wear and tear. Their nature and age mean that they will rarely be in perfect condition. All the Lots are sold ‘as is’, in the condition they are in at the time of the sale, without any representation or warranty or assumption of liability of any kind as to condition by Victor Mee Auctioneers or by the seller.
All lots are sold with all faults, imperfections and errors of description and the Auctioneer and its employees, servants or agents shall not be responsible for any error of description or for the condition or authenticity of any lot.
Written or verbal condition reports may be supplied by the Auctioneer on request but these are merely statements of opinion, and any error or omission in these reports may not be taken as grounds for a cancellation of sale or refund of any part of the purchase price or the cost of any repairs to the lot or lots reported on. Any reference to the condition of a Lot in a catalogue entry or in a Condition report will not amount to a full description of condition of a Lot, and it is important to note that images may not show a Lot clearly.
Condition reports are provided free of charge and are for guidance only. They offer our opinion, but they may not refer to all faults, inherent defects, restoration, alteration or adaptation due to the fact that our staff are not professional historians’ restorers or conservators. For that reason, they are not an alternative to examining a Lot in person or taking your own professional advice. It is your responsibility to ensure that you have requested, received and considered any condition report.
All requests for condition reports must be sent 24hrs before the 1st day of the auction to ensure they are seen and dealt with. Large numbers of such requests are received in the run up to each sale and while we endeavour to answer all requests we offer no guarantee.
By making a bid, the buyer acknowledges that he/she/they have satisfied themself as to the physical condition, age and catalogue description of each lot (including but not restricted to whether the lot is damaged or has been repaired or restored).
2. The highest bidder shall be the purchaser, & any dispute arising either before, during or after the sale, shall be determined by the Auctioneer. The auctioneer reserves the rights to bid on behalf of clients including vendors but shall not be liable for errors or omissions in executing instructions to bid.
3. The Auctioneer may refuse to take any bid without giving any reason.
4. On the fall of the hammer the highest bidder shall be the purchaser. Any disputes regarding the sale in any form. Shall be determined by the Auctioneer.
5. Lots bought by auction must be collected within 7 days. After the expiry of this period, a storage charge of € 5 per item per day will be charged. VMA are not responsible for the items you have purchased after the sale. It is your responsibility as purchaser to have arrangements in place to collect within the 7-day period. If the item/items that you have purchased have not been collected after a two-month period. VMA reserve the right to re-enter said item into a future sale. All proceeds minus any storage fees, insurance expenses, or removal fees, along with any other amounts owed under the original purchase including VAT, shall then be paid to the original buyer.
6. Special Conditions
A) The buyer shall pay the Auctioneer a commission at the rate of 20%. The Buyer’s Premium is added to the hammer price of all lots and is subject to VAT at the prevailing rate.
B) The Auctioneer or its employees, servants or agents may, on request organise packing and shipping of lots purchased or may order on the Buyer’s behalf third parties to pack or ship purchases. Under no circumstances does the Auctioneer accept liability whatsoever for any loss or damage howsoever occasioned in the course of such service.
C) The buyer authorises the Auctioneer to use any photographs or illustrations of any lot purchased for any or all purposes as the Auctioneer may require. The placing of a bid will be taken as full agreement to all the above conditions.
7. In addition to the auctioneer fees if bidding online there can be an internet surcharge, the percentage of which will be advised on their website at registration plus VAT @ 23% is charged on the hammer price. This is charged separately on the invoice and is known as the INTERNET SURCHARGE.
8. A Cash Origin Form must be filled in by the Purchaser for all cash payments exceeding € 500.00. The form must be signed and photo ID plus two copies of proof of address must also be supplied.
9. Should a purchaser fail to comply with these conditions, they may forfeit the deposit & the Auctioneer may re – sell the lot or lots as he deems fit. Any deficiency in the price at the second sale shall be made good by the first purchaser but any surplus shall belong to the vendor.
10. VMA do not accept responsibility for lots damaged by changes in atmospheric conditions nor shall Victor Mee Auctions Ltd be liable for any damage to glass or picture frames.
11. Default, Victor Mee Auctions Ltd Disclaims responsibility for default by either the purchaser or the vendor because he acts as the agent for the vendor only & therefore does not pay out to the vendor until payment is received from the purchaser.
12. VMA does its very best to be honest, truthful and transparent when describing goods verbally and in the catalogue. In person viewing of lots is available. Date and times will be advertised online with all sale details. Although all statements are an option and are not statements of facts, nor should be relied upon as such. Neither the vendor or VMA accepts any accepts any responsibility for any statements as to the authorship, origin, date, age attribution, material, genuineness or provenance of any lots or errors in the description. A mistake in the catalogue is not a reason for a refund.
13. All goods are sold as seen with no warranty, return or exchange and we strongly encourage buyers to seek condition reports and make their own determination on condition prior to bidding. No Refunds or Exchanges on any goods. All prospective buyers by making a bid for any of the lots advertised in the catalogue acknowledge that their attention has been drawn to these conditions of sale and that they are bound by them.
